EB1-OR Approved....now what?

Hi Just received the e-mail from TSC that my EB1-OR NIW has been approved and according to my lawyer I can file for I-485/765 concurrently as the PD for EB-1 is current till Sept 1st according to new Visa bulletin. I am awaiting the 485 package from the lawyers office but I had a few second opinions to ask of you guys:

1. I need to travel to India in February-March absolutely.....what are the travel restrictions once I apply for 485? Currently I am on an H1-B (second year...valid till 2008 January). I dont wanna delay the 485 but my travel in March is a must...should I delay?

2. How long do EADs take to come (I know its 90 days officially) usually in your experience and once I get my EADs can I travel to India on those or do I need to travel on my H1Bs.

3. What does the advance parole stand for?

4. What are the steps after I-140 approval in order that need to be done....when do I do the medical/fingerprinting/etc etc.?

5. Once my I-140 and EAD has come in can I apply for employment and state that now I am a permanent resident approved guy or not? In the sense can i tell them they no longer need to sponsor me?

but do let me know ur EB1-OR NIW means what Eb1-OR or Eb2-NIW or both
1. You can go using AP or your H1b and reenter. make sure you confirm this before your trip as rule keep on changing.
2. EAD doesn't effect your H1b . it takes 30-45 days normally to get EAD.
3.advance parole stands for advance parole......its ideally travel document one use after filling I-485. but since H1b is dual intent people do use that.
4. since you have lawyer he will file I-485, AP, EAd (last two if you need)for you. once he/she file sthat you will get notice sfor FP etc ...you don't have to do anything....its BCIS job...u just pay fee and do what they say.
5.Yup!!! using EAD you can do so!!
and yes ! you will find all your answer in details with loophole and regulations if your surf more in these forums!!
 
Thanks a ton EBI doc.......actually since the lawyer has done most of my work I am not even sure what the exact category he filed withing EB1....all i know is that I did not do Labor cert and its in EB1 category....most prolly its under OR category since I am an MD PhD. I also filed under EB2 OR category which also got approved by the way. So I took no chances...lol. TSC really rocks the entire process took less than a month and a half. I have a friend who is also an MD phD who got rejected from NSC. I was so shittin bricks when i heard of his case. Anyways..... I got the checklist from the lawyer and have scheduled a medical exam for next week.

Fingers crossed and hearts a pounding.

BTW Eb2 doesn't have OR category
you can have this liberty of mistakes as you have lawyer!!!
blame it on centers or give credits to ur qual this is process involve much of luck too!!!
 
Actually I think I was way too lucky. Sometimes I cannot still beleive this. Even though I have an MD and PhD I dont have many publications (7...4 first author), some minor awards and a few conference presentations but I think my recco letters were from top notch institutes (god knows if they even look at the rest of the application) and I had a few newspaper articles about my work. I was lucky to have me the top people in my field during my graduate years and they remembered me...LOL. Personally i think it depends on your Lawyer and your reccos. I was ready for a wait of about 2 years now...lol. Surprise surprise when i got the e-mail two days back. I was like you kidding me? Anyways who am I to complain? I need the EAD to start my new job next year or else I would have to go to the dreaded J1 (shiver shiver). Alls well that ends well...maybe they are finally coming around to giving us guys a break. Hope all of you guys have the same luck. Cheers. Have sent out my I 485/765/134/131/639 today. Lets see what magic the lawyer can work around this time.

Hi Kulbikr,

Congrats for your I-140 approval. Do you mean you are going to mail your I-485 today to your lawyer or to TSC. I think you cannot mail your applications to TSC till Sept. 1, 2006, since EB1 dates will be current from Sept. 1, 2006. For August visa bulletin dates are still Jan. 1, 2006.
