EB1-OR application

Hi, I am new in this board. I have looked all the posts in this board. No denial cases found on EB1-OR application, all the cases get rejected are NIW or EB1-EA. does that mean EB1-OR is easier to get approved? If that's true, I will definitely go by EB1-OR. Any information would be appriciated.
 
Sounds stupid but every case is as good as your credentials and your presentation (petition). If you don't have good evidences and you don't write a good petition all cases are pretty complicated. And it depends on your backgorund if you will have it easier in EA, OR or NIW. There is no geneal rule.
 
The biggest barrier for OR is to have a reliable and profitable employer who has offerred you a PERMANENT REASEARCH job. Otherwise, I think the barrier for OR is reasonably low. Anyone who qualifies for EA will definitely qualify for OR. NIW is a different ballgame.
 
I am working with a Fortune 500 company, here is my background:

1. Ph.D in a so so US school
2. Help my advisor to get a NSF and a NASA award.
3. 2 top Journal papers in my field
4. 1 book chapter
5. 3 papers in China
6. 9 recommendation letters (from professor in US, Japan, Canada, and China, 4 of them don't know me personally)
7. One membership

Our lawyer said my case might get denied, can you give me some opinion whether I want to go for it?

1) OK
2) Doesn't help you since your advisor got the award not you personally.
3) Not much, but might be enough. First author ?
4) Written alone and invited by the editor personally or was your supervisor invited and you helped him ?
5) Since these are not international journals they don't really help you to establish your international reputation
6) Depends very much how these letters are written and which positions these people have. I would try to get also some more independent recommendation letters including from scientists in industry.
7) What kind of membership. What were the criteria to get the membership. Do you pay membership fees ?

Very important is also the number of citations you have and what kind of citation ? Did you worked as referee for a journal (not with the help of your supervisor but invited personally by the editor) ?

Overall I would say without knowing all informations that EA will be nearly impossible but if you have a permanent position you should try to work a few times as a referee to increase your chances otherwise it might be very tough and you should work together with your attorney to get an excellent petition.

If you have good number of citations on your papers,
it would be decent case for OR, IMHO.
