EB1-OR and EB2-NIW at the same time

Hi gurus,
I need your help.
My plan is to apply by myself in the case of EB2-NIW and at the same time for EB1-OR but by my employer. I am not sure if it is legal. Can anyone help me. Thanx.

P.S. I think I can't fill out an EB1-OR on behalf of me = my employer must do it for me together with a job offer???
 
Yes, it is legal.

Yes, an EB-1 OR must be sponsored by your company.

I'm not sure why you would want to go through the expense and trouble of putting together an NIW when your are being taken care of by your company, but I guess that is your business.

thank you very much. Probably, I have to note at I-140 form, that I am filing another petition for OR, but may be not, because actually "I am" filing I-140 as NIW and "my company" for OR.

It is very understandable: anything can happen at the the INS!

I also applied EB1-OR and NIW at the same time. The first one, done with an attorney and expected to be straightforward, has been denied. The second one was done without a lawyer and has been approved.

So, it's not a bad idea to increase your chances. Besides, with OR you are dependent on your current employer while with NIW you have more freedom.

When you do the NIW by yourself, does the materials that the lawyer prepare for the OR is useful for your applying for the NIW?

I also have the same idea to do both the NIW and OR, but I don;t know how to begin the NIW, can you give me some suggestion?
