HI,
Just wondering if anybody\'s petition for EB1-EA was approved without a Ph.D. degree (i.e. Ph.D. student) ?
 
Very Rarely and not recently

A few cases of this sort have happened long time ago,
in VERY exceptional circumstances,
but none that I\'ve heard of recently.
 
Way beyond

The actual threshold for EB1(EA) these days tends to exceed the
minimum criteria stated greatly. The real keyword is "sustained national and international acclaim" evidencing "the very top in
the field of endeavor". I can\'t think of more than a couple Ph.D students in the whole country meeting this: I\'ve got my Ph.D (Chemistry) from a top-10 Private US University, and haven\'t seen any student getting EA even there. The real feel for what\'s needed can be obtained by reviewing the CVs of successful cases posted in public forums or talking with a highly reputable law firm with lots of EA experience (these regretably aren\'t cheap).
 
I agree with you,

now it is way beyond a PhD student to even consider to apply through this catagory. Until after you get your PhD, you see if you are at the top.
 
It depends on your luck

My fellow graduate student, who had a lot of papers on "Science" and "Nature", was denied. He had received his PhD degree at the time of RFE. Our school is technology type and is located accross the Charles River from Boston back bay.

A lady with a Bechelor\'s degree in the early 90\'s (who has been an undergraduate student of education and a part-time language instructor at a trash-grade school for the past four years) got EB1-EA approval recently. Do not ask me why.

The point is that you do not lose anything.

No you do lose a lot

By filing an I-140, you prima facie document your "immigrant intent",
which would, most likely, be a valid ground for subsequent denials of F-1 renewal as a Ph.D student, J-1 that you may need as a postdoc etc. after Ph.D, as well as their dependent F-2s and J-2s, very
likely TN (if applicable) and B-1/2 as well. Think before you jump.

Thank you for the info. I just wanna give a try while I am really hoping for NIW. Won\'t lose a thing except that immigration intent, right? But who cares at this stage.
