EB1-EA self petition is approved

Hi guys,

I have received a Thanksgiving gift from INS on Friday. My EB1-EA self petition was approved even without RFE. Concurently filed EB1-OR is still pending.

I think the major thing (besides of necessary qualifications and credentials) is how you present and prove your case. I fired my attorney and spend about 9 months for the preparation of both the petitions. It was like writing a paper for Nature or Science. But it was worth of it!

Good luck to everybody. This forum was of great help to me.

Does anybody know how to link an approved stand alone I-140 with already pending I-485? Need to know what to do next.

Congratulations! Did you submit I-140 and I485 applications separately (non-concurrent). Usually one submits I-485 application after I-140 approval if it is not concurrent. What is the basis of I-485 application. You may be be asked to submit I-140 approval letter before approving I-485. Good luck!
 
The basis for my I485 was concurrent filing with I140-OR, which is still pending. I140-EA was submitted later as standalone application. What I want to know is if I can substitute pending I140-OR with already approved I140-EA in my concurrent I485. I do not want to withdraw my pending 1485 and loose money and time by filing new I485 based on EA. Also, would not like for my I485 to be at the end of the I485 queue. Besides, I am not sure that my I140-OR will be without problems because my position depends on grant money (not actually a permanent one).

Should I just send a letter to USCIS asking to link the approved I140 to the pending I485, or should I do something else?

My case is reverse. I got my OR approved and NIW is pending. I had to initiate the OR petition with my attorney who suggested me to go for labor cert. Now, I guess he turns around and exploit the results any way. Here are my detials.

OR Notice Date: May 26, 2004
Approved on December 6, 2004

Quals: PhD in Physics, interdisciplinary research, applications into nanotech, 10 papers, one journal review, and one professional association membership. Seven letters of which two from non-collaborators. If I can win, any body with a PhD should be able to win.

My NIW is still pending.
