EB1-EA RFE from NSC. Please help!!!

Folks,

I have found this to be an incredibly helpful forum for EB1 and NIW categories. I just recently submitted my EA1-EA petition through my attorney to the Nebraska Service Center with premium processing. I received the following RFE today (6/26/07) with a deadline of 9/17/07.

1) Additional evidence of national or international honors and prizes you have won
2) Evidence which will establish the imp and budget size of the projects you are handling at present such as at your current employer and any other
3) Articles or excerpts from trade publications, journals or magazines in which your unique achievements are commented on by peers, major media articles in which your name is mentioned

I am very disappointed with service from my attorney, and I hope for some valuable inputs from the forum's membership. Can someone please shed some insights about whet they feel regarding the current status of my petition? I don't know if all hope is lost or there is some marginal effort required that can turn this turn the case around. If so, what do you recommend as a follow-up to the RFE?

Here is some background info on my case. I claimed the following eight categories:
1. Receipt of lesser nationally or internationally recognized prizes or awards;
2. Membership in association in the field for which classification is sought, which requires outstanding achievement of their members, as judged by recognized national or international experts;
3. Published material about the person in professional or major trade publications or other major media;
4. Participation as a judge of the work of others;
5. Evidence of original scientific, scholastic, artistic, athletic or business-related contributions of major significance;
6. Authorship of scholarly articles in the field;
8. Performance in a leading or cultural role for organization or establishments that have a distinguished reputation;
9. High salary or remuneration in relation to others in the field;

I have my bachelors degree in chemical engineering from India. I have masters and PhD degrees in chemical engineering from US in 2001 and 2002. I have received a graduate student paper award for my doctoral work, listing in two editions of Who's Who, university fellowships, National Talent Search Scholarship etc.

I have membership in Tau Beta Pi, Sigma Xi, and Mensa.

I have reviewed papers for eight journals and several conferences. Furthermore, I have co-chaired international conferences.

I have received close to 35 citations in journals, conference papers, and several more letters or e-mail expressing interest in my work.

I have co-authored twenty five papers in journals and conference proceedings. I have co-authored seventeen conference presentations, and presented some more seminars and lectures.

I submitted ten letters of recommendation, from both people that know me and those who don't. These include a letter from a VP of my company that attested to the importance of the projects I have worked on.
 
I think you have claimed almost all criteria. You must strong points only like....scholarly articles (publications), significance of your work, and review of other's work. You should mention your weak points like memberships, awards somewhere inbetween the cover letter. Thats how my lawyer did.


Ask ur lawyer or hire another lawyer to reply your RFE. Make sure you claim STRONG points only and rewrite your cover letter.

I agree with Lakshmanan. What is the point in claiming something which is not well evidenced? It will just make unhappy the reader of your case.

I'm playing the devil's advocate in what follows...

I have received a graduate student paper award for my doctoral work, listing in two editions of Who's Who, university fellowships, National Talent Search Scholarship etc.

Awards for undergrad/grad work is not that much considered... but if it is really a veryspecial fellowship awarder to a evry few people. Don't bother even mentioning Wh'sWho or other listings of that kind...

Reviewing papers is done by a large fraction of the scientists. Chairing a session, or chairing the SOC?

For how many papers in refereed journals? Not that many citations for somebody who is supposed to be one of that small percentage that risen to the top of your field.

Conference proceedings are not that much appreciated, compared to articles in refereed journals. How many of them do you have?

I agree with ChrisV.

the best strategy is to look at your credentials and identify all the best strong points. Then see if you can fit in at least 3 criterias. In your cover letter just claim your strong ones.
