Hi everyone!
I represent a client currently working in the US under an E-2 Visa in the field of Business Development.
Outside of this employment and since an early age he has also been writing and performing as a musician. In the past four years, he has concurrently worked while here in the US to build a resume for himself that would support an EB-1 application and we now feel that he is ready to move forward with this.
To keep this email brief, I would like ask four questions after giving you a brief resume of his achievements and the letters of recommendation that we would be able to provide.
EB-1 Green Card Application for aliens of extraordinary ability engaged in the arts, sciences, business, education or athletics.
In order to qualify for the EB1-EA, the applicant must have won a Nobel Prize OR show documentation in three of the following areas: (I've highlighted those we're confident in)
* Receipt of lesser nationally or internationally recognized prizes or awards for excellence; (expected to be recognized by a reputable songwriting competition (an international organization) in their 2008 Awards).
* Membership in associations in the field that demand outstanding achievement of their members, as judged by recognized national or international experts; (A member of ASCAP, we could arrange a letter of recommendation from the director of membership. He has performed internally at showcases to the ASCAP staff by invitation, something not afforded to even 1% of their members)
* Published material about the alien in professional or major trade publications; (He has several US and UK printed pieces of press, as well as dozens of online articles. Has also appeared on US television twice, Fox and Comcast, both shows were broadcasted nationally.)
* Evidence that the alien is a judge of the work of others in the field;
* Evidence of the alien's original contributions of major significance to the field;
* Authorship of scholarly articles;
* Display of the alien's work at artistic exhibitions or showcases; (Performed live on two television shows nationally. Featured on a reputable songwriting competition, performed for ASCAP)
* Evidence the alien has performed in a leading or critical role for organizations that have a distinguished reputation (Primary client for a large publishing/licensing house in Los Angeles as well as other licensing companies. Both would write letters of reccomendation)
* Evidence that the alien commands a high salary in relation to others in the field; or
* Evidence of commercial success in the performing arts. (Had had songs licensed on MTV, ABC, Lifetime and in several films. Has re-couped an average of $2000 per placement and in some cases as high as $10k. We could get a letter of recomendation from MTV and ABC to support future licensing opportunities)
Questions
* Are these qualifications realistic?
* Will filing a I-140 Petition to the USCIS risk his current E-2 status?
* How much documentation to support this case do we need.
* How long does this process take?
