EB1 EA, or NIW

Hi Guys,

I have some questions that I would like to get some help:

I have been trying to apply for EB1-EA or NIW.

Credentials:
PhD in Electrical Engineering, Respectable School

publications (8 journals, 20 conferences) all in very reputable journal/conferences.
Reviewed some Journal papers (different journals and conferences),
No major prize,
15 recommnedations (10 Schools, USC,UCLA,CALTECH,PRINCETON,UC DAVIS, PERDUE, 5 Companies Manager Level)
one US patent,
Membership: IEEE, phi kappa phi, OSA

I hired a lawyer with the idea of EB1-EA, however after a while he is pushing me toward EB2-NIW.

Note that I have already filed another I-140/I-485 through my current employer, With all the risks acsociated with the employer (such as lay off and ...)


Based on the situation and my credentials (Previously people on the forum thought it is too weak) do you think If I should not apply and try to win my money back from my lawyer?

If I want to apply for either NIW or EA as a back up plan, which one do you recommend?

Another question on different topic: Is there any risk with traveling on AP without having my I-140 approved? would you recommend it?

Your credentials look similar to mine and my lawyer seems "confident" that NIW will work. As long your work is cited (my lawyer recommended 60+ citations) and it has "substantial intrinsic merit" (you are doing something important) its certainly not a total waste to try NIW. Plus, moneyis a one-way with lawyers. I doubt you would get it back anyway.

The bigger issues is when your petition will be looked at at this pace :( My application is pending at Nebraska and they are processing August 2006 at the moment and that hasn't changed in 6 month or so. Currently applications "in the national interest" have the lowest priority in Nebraska (which is ridiculous, really).

Your case is weak for EB1-EA. You can satisfy publications and their significance. How many citations do you have? What reviewed some journal papers?......this is third criteria....U suit for NIW very well and go for it if you are from ROW.

My bet is for NIW

Hi my bet is for NIW. But it wouldn't hurt trying EB1-EA. Just shoot and see.
