EB1 EA and Schedule A: Transfer of I-485

Hi,
I had applied for EB1-EA in May 2, 2006 and got the I-140 approved in June 5, 2006. However, due to retrogression could not apply for I-485. As my company needed me to travel in Oct. time frame and the chance of further retrogression according to Aug. bulletin, they submitted an application under Schedule A, Group 2 (Aliens of EA ability in Sciences) along with the I-485, EAD and AP on Aug. 1, 2006 which was current at that time. Now that EB1 is current from Sept., is possible to link the I-485 to the approved EB1 140 or do I have to submit the application again?

Which service center did you file your case? If it is TSC, you may get a decition on your Sc. A fast, may be before Sept 1.
 
It is TSC. However, EB-1 gives me much more flexibility as it is a self petition. Also the Aug Visa bulletin says that Schedule A visa no.'s may finsih this year. In that case this petition will revert to a standard EB-2 with long wait times. So I definitely want the I-485 linked to EB-1, either a new one or transfer the old one.
 
I have an EB1-EA also from TSC......I am going to file I-485 soon. I had also heard that the visas for EB1 might be getting over or already over. However my lawyer states that there is a good chance if i file before Sept 1 I might be in time....dunno....hope everything works out. I dont understand what is schedule A or B?

I am not sure whether you can file I-485 before Sept 1 as EB1 is current for Sept bulletin not for August!!

Schedule A is basically the quota separated for Nurses and Physical Therapists in Group 1 and EA ability in Sciences and Arts in Group 2. Criteria for Group 2 is roughly same as EB-1 EA. I think a 50,000 limit was set last May 2005 but may expire soon.
