EB1 Chances!!

My Employer agreed to file my EB1-OR application.

To summarize my qualifications!!

Authored Nineteen research papers (16 published + 3 communicated), Eleven academic presentations, Filed one U.S. patent, two international award 3 national award. Reviewed several academic papers for professional journals and wrote a review on the biotechnology of carotenoids, Numerous reprint requests of my published papers, Several professional society memberships. 132 citations mentioned by other people in their published papers. Several witness letters... I have never worked with 73% of the reference/witnesses.

Well My position is Research Associate (with all benefits). As many can't differentiate between postdoc and RA. Most of my witness letter will have recurring word addressing me as postdoc.

One guy from our laboratory got rejected as EB-EA so employer is going for OR for me too.

My question is related to recent discussions in the forum. Although my employer calls me RA with permanent position will the letters from others effect my chances of OR? There is no way I can ask them for letter rewriting.

I will appreciate comments from experts about my qualifications and chances.!!!
 
If your offer letter doesn't indicate any "end" term regarding your offer, then it is a permenant position. For example, if the offer letter says something like "the contract needs to be renewed every two years", "the employment term is from ... to ...", then you might get trouble. But if the letter says the employment is "at will", then you are OK.

I would strongly advise to have a phase such as "we require the permanent outstanding research of Dr. XX in our department" from someone with the university HR department, not any facutly member that you are associated with. Espercially for university appointments, be wary of "at will" employment terms. I would also consider going through the AAO decisions at the USCIS website.

If I were you, I would get the letters redone taking out the post-doc phrase. This is only going to generate RFE's or something else not pleasant. I know it takes time, but an "approvable" packgage will save you money, and in the end, time.

Along with HR letters, I have strrong letters from employer and Director of institute about my permanent positions without mentioning limit of employement.

Well, I have decided to eliminate those letters which mentions "postdocs".

Well, about my qualifications. Which one of teh criteria shd I highlight?
