EB1 category for H1-B holders

Dear All,

Can a H1-B visa holder (going to complete his PhD end of this year and having many research publications ) already working for a company in USA , apply for green card under EB1 category?

Yes,
I have H1 visa, I applied EB1 and EB2(NIW). Both approved.
Right now I have H-1 visa( just extended)
 
sorry to digress.

Patient66 have you filed for your I-485. If so, did you apply before having your H1-B visa extended?

Yes, I filed my I-485 oct 2002 before my I-140 approved. My old H-1 expired June 2003. My new H-1 visa approved on 06/30/2003, the day my old one expired. I have EAD card. But I did not use it. It will expire in Nov, 2003.
