Hi, My EB1-B 140 got denied last week. 485 and EADs have not been denied yet. I am considering filing an appeal. My question is while the appeal is pending are our EADs still valid? I have H1-B till 2012 but my wife may need EAD for her employment. Our attorney says that our 485 and EADs are all dead, the moment 140 was was denied but if the appeal is successful than they will be alive again. Until a decision on the appeal is taken, we can not use any privileges of EAD even though online status still may show both 485 and EAD to be alive.
