EB1-3(L-1A) changing job in 485

EB1-3(L-1A) requests the employee must working at least 1 year in the same company oversea branch as manager before. This category (EB1-3) is for intracompany transferees only.

Question:

1) Does EB1-3 can change the employee base on AC-21 after 180day 485 like other EB (H-1)?

2) If so, does the new company has to be a multinational company? (Note: There is no way to meet the 1 year oversea working requirment anyway for the new company.)

By the way, I heard that CSC rejected a EB1-3 case, because their oversea company was closed during the long 485 pending.

So, I am not sure whether EB1-3 can change the job or not after 180days 485.

It logically makes sense that the same rules apply...

To me logically it makes sense that all employment based I-485 applications have the same conditions and therefore the 6 month rule should apply. I do know that there are different preferential categories for I-140 (EB1, EB2...)

If you cannot change employers at all, why does INS even bother giving L1A holders an EAD?

Having said all this, the INS doesn't always do things based on logic...
