EB-2 PERM while EB-3 is approved with I-140

Can I file EB-2 PERM now after getting I-140 approval with same employer for a EB-3 position?

Gurus please answer.

I am in same boat. I got EB3 approval and planning for EB2 using same employer. Did u find any way ?

My attorney told me that I can do that. So I asked him to file Perm under EB2 although my Labor and I-140 is already approved under EB3 with same employer.
