Hi guys!!

There is an approval from TSC (I-140 EB-1EA) today. Took less than 2 and half months. Again TSC proved to be fast in approving I-140 (EB-1EA). MY I-140 is pending at NSC for more than 106 days :)

PS: Hi good_y! we have to really wait for our I-140 I think

Great TSC is so fast, whyis NCS so slow. my friend got her EB-1EA approved from TSC last month. adn she filed in July 2006....
and were still waiting..... is going to be 3 months for me this week..mmm
will see

NEED HELP Received RFE from NSC EB1 Premium processing

Hi,

I had applied for EB1 oustanding researcher and professor in May 06 and then requested premium processing in Oct 2006 and last week got RFE which says...

Additional documentation on international recognition etc.....same generic letter that includes the requirements of the category.

Previoulsy, my university sent this application and now after the RFE, i got my own lawyer to work on the RFE.

I was wondering what would be better, my lawyer submits it the RFE packet or I take the RFE packet and have my university send it. My school suggests that its better that they send it and the laywer suggests otherwise.

I am not sure, which is better? Any opinions or experiences.

How your university allowed you to hire your own lawyer? Usually if you are applying through university under OR category the University will take care off BUT I do not think the University will bother about whether your case will be approved or not. If I am in your place I will get all the help from the lawyer and let him/her makes the RFE packet. The same can be submitted by your school (whatever you call) as if they made that. Initially who wrote the cover letter when I-140 petition is submitted?

Good luck

CLOSE to 4 months after I filed I-140 petition (EB-1EA). Still I do not see ANY light from NSC.

I am hoping we can hear something soon...what are they doing in there...they are taking alot of time..the worst part of it is that we dont even have any LUD meaning they even havent touched or files in months!

EB1 - I140 Approval Still Waiting

I'm also still waiting.

RD: June 28, 2006
LUD: August 12, 2006
AD : Hopefully soon

I have a question though: I filed by using concurrent filing (I140 & I485). Should I expect approvals at the same time? Does anyone have any idea?

Thanks

My lawyer said that with looking at the current phase of NSC she estimates that I might hear something around December. And i filed July 21, so...I guess will wait and see...

She also said that since Agust everything in NSC slowed down big time!

Guys, I need help. I got a RFE from Nebraska. It is a long RFE but seems really complete. Here are the question highlights:

EB-1 Criteria: Published material in professional publications
written by others about the alien's work in the academic field:

Q) Provide evidence for professional publication written about
others
about the beneficiary's work in academic field, please provide
articles (Surprisingly, they say that citations of the beneficiary does not
constitute published material about the beneficiary)

EB1 Criteria: Authorship of scholarly books or articles (in
scholarly journals with international circulation) in the field.

Q) Submit an explanation along with corroborating evidence, which
illustrates how the beneficiary's publication record demonstrates
that he is internationally recognized as outstanding in the academic field.
Provide documentary evidence of the circulation of the journals that
published the beneficiary's articles.

Any thoughts on how we could answer these questions? I would really appreciate your help.

EB-2: exceptional ability in the sciences.

Does It qualify for EB-2: exceptional ability in the sciences.

An official academic record showing the alien has a degree, diploma, certificate or similar award from a college, university, school or other institution of learning relating to the area of exceptional ability;
1) Master of Technology in Electrical Engineering

Letters documenting at least ten years of full-time experience in the occupation being sought;
2) 3 YR Exp in Research (Hydrology) & related Software Dev + 8 Years of Software Development in IT and presently working in IT as a Technical Team Lead / Senior IT Architect

Evidence that the alien has commanded a salary or other remuneration for services which demonstrates exceptional ability;
3) Annualy salary of $90,000

Recognition for achievements and significant contributions to the industry or field by peers, government entities, professional or business organizations.
4) Three Research papers published in indian local journals - no record available

Need help/suggestion

Hi All,

I am facing a crisis and any suggestion/feedback is appreciated on the following issue.

I filed both I-140/485 concurrently under EB-2 NIW in Sep. 2005 at VSC (for my wife I-485). So I am the primary applicant. I got I-140 (EB-2NIW) approved on March 1, 2006.

In June 2006 I filed I-140 EB-1a at NSC. Since then the file is pending at NSC. On July 13, 2006 our I-485 file has been transferred to NSC from VSC and I got the transfer notice from VSC.

We did not realize the mistake made by VSC where they have given me two A# (one for I-140 and another one for I-485). IT SUPPOSED TO BE ONE NUMBER. In both I-140s (filed under EB-2 NIW and EB-1A) the same A# is there. Surprisingly the assigned A# for my I-140s is the same number of my SPOUSE A#.

How to go about this problem? Hope you got the problem what I am facing right now.

LOOOOOOONG LIVE USCIS.
