Hi!

Is there anybody who can shed light on processing time under EB-1A filed at NSC? Usually how much it takes to adjudicate I-140?

What will happen if she gets a job in a company (working with EAD)?

What are the possibilities that my I-485 can be denied (extreme worse scenario) at VSC (EB-2 NIW)? At that point can my wife get back to H-4 status (ofcourse she cannot come back to H-1 status) or she will have to leave the country? She is having 4 years of post doc experience. She has more chances of getting job in companies.

I need your input on this.

Yes she can ! Your lawyer can file H4 for her based on your H1B (if you are maintaining one) using premium processing. she doesn't have to leave country! just file H4 as soon as you get denial (ofcourse worst scenario).........but to tell you i have never seen I-485 getting denied for any small reason...unless you hav edone major blunder with INS.All the best fro her job search

I work in University on H-1B as a research assistant and so is it required to hire attorney to file my wife's H-4?. Won't University (Center for International faculty and student services who did my H-1B paper work) file petition for my wife since she is dependent? Please let me know.

just let them know you want to do premium!
some university / employer agrre to pay extra money require dfor premium some agree that you can pay that money!

I wrote to eb-1doc saying that my I-140 (EB-2 NIW) got approved - filed in sep. 2005.

Now I have filed I-140 petition (EB-1A) (took a chance).

Do you think USCIS is so EFFECTIVE? :)

No, I thought I am misunderstanding something and I wish they are effective. Thank you for clarifying. Now I remember your case. Did you get your receipt notice yet? Which service center had you filed your NIW? I am now planning to apply for NIW on my own as I kinda lost hope on my EB1A. It would be good to get a model cover letter for filing NIW. Do you think you can help? If so please send me a PM. Also are you using the same reco letters for EB1A?

using same letters for both cases is practiced with 50% chances!
well..............NIW focuses also on NI & substancial merit and letter salso explain about labor issue.....etc...EB1EA focuses on ur extraordinary skills...........abilities..............good mix from both types will help.........but using exact replica package might not! ......in cas eo fno choice try getting letters saying letter sfor LPR application....and submit the copy to each!
