EB-1 OR denied NSC

Just got fax about EB1-OR denial.

Briefly they said ''I am highly a regarded scientist but that doesnt mean I am outstanding''.

Its frustrating to lose time and lots of $$$ (top lawyer for RFE). I was surprised because I am a faculty member in a top 10 medical school in the country and I have solid publication record and what not.

I thank most of you for helping me with many things. I dont think I will visit this forum atleast for a while.

This whole exercise with Premium Processing is totally unfair and the probability is as much as toss of a coin.

Good luck to other folks but dont get too upset with denials. Life is lot more than this. The fun part is I dont have any other category approved or anything. Now I have to find a way to extend my H1...

PS: Please dont analyze too much on receipt dates, LUDs, efiling, how to send, when receipt will come, cos I did on a few of them and there is no way to statistically come to a meaningful conclusion

dnastar I am so sorry about your denial, I am sure is hatd to deal with, specially when you know you have all the criteria. Nsc is playing way tough, is weird. Are you thinking or refiling again? what did your attoreny say?
 
What happened to NSC?

Be strong! You are a faculty member, then your unversity will help you figure out how to extend your H-1b.

So sorry to hear this dnastar-- your case looked hopeful. This is scary for all of us! It looks like NSC used to focus on the whole "permanent job offer" issue, but since there was a recent piece of advice posted in the adjudicator field manual, they are back to the standard line about "they may be a good scientist but that doesn't make them outstanding...blah blah.

I too am a faculty member of a top school, and am getting really worried. I haven't gone for PP, and the lawyer has advised not to do so at this time given all of these bizarre RFEs and decisions.

I wish you the best, and hope you can find another route. Maybe NIW?

I am really sorry to hear the worst news. It is really unfortunate to see that a person of your qualification is recognized, then whom they think is a suitable person in this category?
I hope you can submit in other category and wait or do as madgu-gc did.
As you said, ther is no meaning for updates and receipt dates, lucky ones are poicked up.

Sorry to hear about the news dnaster! I know it really hurts us. Take a deep breadth and refile it again. This is not end of our life buddy. NOw my EB-1EA is at TSC. NSC is acting very tough and we all know that whoever is adjudicating our case are not even eligible to evaluate our case BUT they are doing it. what to do? Don't loose hope and you are a faculty member in one of the top medical school. Hopefully your refiling can go to TSC. I am getting ready for sending the supporting documents to TSC this week hopefully.

Nothing is impossible and we can do it. Have confidence buddy.
