A person has been approved for E-1 I-140 in the category of Alien with Extraordinary Abilities (EB-1).

I-485 has been filed more than 6 months ago.
The person is in danger of being fired from a job.

1. How long may the person stay out of jobs?

2. What is the chance of RFE being issued, requesting paystubs, etc. ? And does it matter for EA category?

3. Should the next job be equivalent to the one filed in I-485? EA category, in principle, doesn't tie I-485 to jobs, but ...

4. If a new job is found, should the person notify INS? Again, EA is not tied to jobs, but...

5. If the person applies to grad schools, after fired, what
should be put on the application -- GC holder or "foreign national" with H-1, who needs F-1?

6. When University will apply for F-1's I-20 -- will this jeopardize the I-485?
 
1. legally,Until GC approval. Practically- not even for a day.
2. Based on luck (random local transfer), previous (sponsoring) employer's attitude.
3. Operative word is similar job...So in principle...
4.Not necessary so far, awaiting INS regulations on the notification to INS regd job change exercising AC21
5. Unless U have a 485 approval or GC card U are not GC holder. Anybody can be GC applicant
6. Yes, On 485 (and on EAD) U dont need I20... I might be inaccurate...Consult yr international counsellor..
