Hello friends,

Firstly, Is it good idea to file I-140/485 at the sametime? or is it advantegeous to file separately?

If I file it jointly, when can I apply for EAD? Should I wait for 140 approval, before I file for EAD?

Thanks in advance!

Hi helpwanted...

It is difficult to say if concurrent filing is advantageous or no. my experince in this forum, at different point of times there were diff discussions regarding this.

If u file concurrently..u can apply EAD at the same time. But your EAD will be approved only after 140 is approved.(there are some cases which EAD were approved before 140..but I dont know on which scenario)...

look for more info in this forum....

When U file concurrently, as far as I know, EAD comes before 140 approval. But they will just review your 140 bfor issuing the EAD.

Concurrent Filing

There are advantages and disadvantages about filing 140/485 together. EAD/AP will be approved if at prima facie 140 looks ok.

If you have 2-3 years remaining on your H1 then it may not be necessary to file concurrently. You also have to look at your job security, that is if you are confident that your job will be secured(?) for another 2 years. then you do not need to file concurrently.

Main advantage of filing concurrently is that your 485 date will be ahead of others by 6-8 months and if you need to change jobs after approval of 140 then you will be able to do that sooner. You should discuss this with your lawyer.

Good luck!
