EAD with wrong country of birth

Hi,

I have been a regular observer of this site and had posted some activity when I was waiting for my green card a couple of years back. Now I have a question regarding my wife. She received her third EAD in August but they printed the country of birth incorrectly. So based on what I saw on the discussion board, we applied for the EAD again (though my attorney) and sent them the original card back and kept copies. This was despite the fact that the attorney said it is not required and that my wife could work on the incorrect card.

Now the problem is that we have not received the new card yet. And my wife's current EAD expires on Nov 7th. The 90 days of the new card does not occur till the 22nd of November.

The question we have is -

Can she work in between the time that the current EAD expires and till we dont get the new card or the interim EAD.

Her work place has a copy of the incorrect EAD card and they said that would be fine and once she gets the corrected one, they will just update the records.

What should we do ? Can she (work) get paid in the time from Nov 7th to the time we get the new card or interim EAD ?

Any advise and suggestions would be most welcome and greatly appreciated.

Case details I485 ND 08/01, FP 03/03, new EAD ND 08/03.

To my knowledge Mis spells in EAD card are quite common. So you need not bother about them that much. All that is important is your A# on the card.

But comming back to your question, If your wife has a card that is not expired, in her possession, then she can keep working. But I am not sure if she can work using the EAD copies. You may want to consult an attorney regarding this. But she can always go on leave of absence if it is a problem. Or work for that time but get paid later or something like that.
 
Thanks for the reply. My attorney says that since the work place has a copy of it already, it is fine.

And she can keep working since she has a valid EAD.

He says she can wait for the new card with the correction. and there is no need for the interim ead also.

So I dont know what is the correct course of action.

Attorney says she can work. Your advice and my gut feeling seems to be otherwise.

EAD approved

We received my wife's EAD on the 21st of Nov (exactly 90 days from the notice date for the EAD).

This time all the data was printed correctly (thankfully).
