EAD - What will happen if I work without it?

My question is, what are the ramifications or repercussions of working while waiting for your EAD??

I have heard they can deport you...but have also heard this would never happen, and that it is a scare tactic that is used to deter people from doing so.

I see many post of people waiting for their EAD card, but what would happen if they did??

I am not working, but have considered working (have my SS#), since we are financially having trouble since my wife was in a car accident and can't work, and I can't find anyone to hire me for cash.

We are currently going through the AOS process and MAY have the EAD card in 5 weeks, but the way some people talk...it seems like it will take longer. I can't get my temporary (wish I had went and applied while in K1 status!), because we are not outside the 90 day period of having applied for the AOS & EAD.

Thanks

If you are filing based as the immediate relative of a US citizen (and if you had K-1 status, you apparently are) then you'll be fine. Take care of your family.

I hear if unauthorized emp is less than 3 mos, it's usually o.k..
Also, some people arrange something with the emp and work without pay while waiting for EAD, and once the card arrives, they get paid back. Of course, this is against the rule, strictly speaking..

When I was in a similar suation to yours, I basically volunteered to work without pay. This is also illegal, strictly speaking, but my lawyer told me that in my case it would be alright. I'm a college prof and my position's not too easily replaceable! So basically I lectured and did other tasks as a prof without pay and never got paid back (for about 2 mos). My school is public, and so backpay is definitely not allowed.. My colleagues were very supportive & sympathetic, though -- they bought me lots of luches and dinners :)

Good point, realcanadian! But I guess I just chose to do what was o.k. with the univ/employer! Anyway, that's all in the past now..
