EAD - Travel

Hi ,

I need to travel withing USA on labour day weekend . My first EAD eapired on Aug 6th 2004 . I applied for my second EAD in April 2004 and is still pending , but i have the reciept for the same with new LIN #. Also the visa and I-94 on my passport are expired as i am on my EAD with my employer now.

My question is , i am travelling to NJ on labour dayweekend from florida . Will there be any problem for me if i just carry my previous EAD, i-140 approval, -1485 RECIEPT AND 2nd EAD extension reciept with me ? I do not have my 2nd interrim EAD yet.

All you need is a valid govt issued ID (typically your DL) for id purposes. Intra USA travel does not require carrying passport/visa. If your DL has expired or you dont have one, in that case, you might have to carry all your papers to support the claim of pending AOS.
I switched to EAD last year and haev travelled within usa many times and I have never carried or was asked to show my passport. DL for ID purpose has been more than enough.

Think about it - you can drive to the store without having an advanced parole (BTW, INTERcontinental travel requires an AP, not an EAD, assuming you're not on a visa like an H1B that allows it). And you can drive from Florida to Washington state without an AP, so why not fly? As mentioned, intra-US travel requires no immigration status proof at all.
