EAD to H1

Hello all,

485 got denied. Working on EAD. Filing Motion to Re-open. Can I do a new H1 again if employer is willing?

Is it true that there is no quota if H1 was applied within the last 6 years ? Has anyone done this ?

p.s: I plan to check with attorney next week anyway, but was wondering if I could find the answer over the weekend.

----------------------in past you posted that I-485 got denied for your Spouse? if I-485 is denied for your Spouse then at present what is your status?? if I-485 got denied for you what is your spouse status?

Primary applicant: spouse, Was working on EAD, 485 denied.
Me: H1, 485 denied as well bcos primary applicant's 485 was denied. I was never working on EAD.

My question: Can primary applicant go back to H1? Will quota affect her ?
Is there a rule that states that she wont come under quota since H1 was filed in the last 6 years ?

---------------If I remember her I-485 got denied as her I-140 was revoked

Me: H1, 485 denied as well bcos primary applicant's 485 was denied. I was never working on EAD.
--------------------- if your spouse was Primary and her I-485 got denied and your I-485 was derivate that has to be denied. if YOU never used EAD and have H1 status you are OK. that is the reason many lawyer say to keep H1 status even if you got EAD.

----------You Need to post full Details: when was first H1 petition approved and on what date entred US, any H1 extension, when was LC filed,till what date her I-94 is valid. Go to a good lawyer with all documents.

Everything happened in the last 3 years. I-94 and H1 valid till 2009.
