glad to hear this.

But what is the point of getting an EAD? You do NOT need one.

I have restricted SSC and can't change it without walid EAD. I know that I should be able to but SSC administration doesn't think so. And I do not want to explain myself every time I apply for a job.

You can absolutely change it if you ask for it. Every other asylee or refugee in the USA can.

Then can you explain how come everybody on the planet can get one. The policy is there black and white on the SSA website AND on the USCIS website. How can there be disputes about the policy??????

And you have no time to take care of this but have to time to fill out an EAD application every year and then go your HR department to update your I-9? How much time does filing a complaint with SSA take (assuming that your local office really deviates from national policy)????? And you are risking dismissal by your boss if your EAD is not extended on time?

Are you wealthy enought that you do not care about money wasted on this needless exercise?

It is hard to believe that you cannot get it changed since this has been national policy for more than four years now. It is your right and you should demand it by escalating it. It is really easy. I had this problem back in 2001 when the policy just came out. All I needed was to speak to the office manager.

I did speak to the office manager. and this is what I was told. "You need a valid EAD in order to get a new card"
And thanks for your advice.

I had this problem with the SSA earlier this year when a relative asked for a change on her card based on asylum approval. Rather than dealing with SSA clerks I called the SSA central office in Baltimore. I called Commissioner Jo Anne Barnhart's office and spoke with one of her assistants. She took down my information. Later that day the local SSA office called and invited us back for processing. They were very apologetic. A few days later Ms. Barnhart's office actually called us to make sure that the problem was solved.

This is the United States and the government is here to serve you. Do not be afraid to assert your rights.

Ms. Barnhart can be reached at 410-966-8323

What type of documents did you present to them to document your asylum status?

And did she mean that once you show her a valid EAd then you will receive a social security card that has no annonations on it so that you do not have to renew your EAD ever again?

Please clarify?

coming from the SSA website--no argument needed.

All refugees have employment authorization based on their status as refugees.

All individuals granted asylum are authorized to work based on that status. An asylee does not need to show an employment authorization document as proof of employment authorization when applying for a Social Security number and card. However, some asylees may have those documents and provide them as evidence supporting their application.

The Department of Homeland Security (DHS) now considers aliens granted asylum to have permanent employment authorization and requests that we treat them as permanent resident aliens. This means that when an individual granted asylum submits appropriate documentation with an SS-5, we will issue an unrestricted Social Security card.

Like refugees, asylees are eligible for assistance and services from the Office of Refugee Resettlement for a limited period of time starting with the date asylum is granted. Because asylees need to be enrolled in certain programs within 31 days of the date they are granted asylum, it is important that the Social Security Administration assign them numbers and issue their cards quickly.

The Executive Office for Immigration Review (EOIR), a separate office from DHS, also processes requests for asylum and may grant asylum.

NOTE: This does not apply to an individual who has applied for asylum or who has been recommended for asylum.

What document does an asylee need to show to get a Social Security number and card? When an asylee applies for an original or replacement Social Security card, accept as proof of alien status any of the following:

An I-94 with a stamp showing the individual is granted asylum under section 208 of the Immigration and Nationality Act (INA). NOTE: Some I-94s issued to asylees are stamped or annotated "EMPLOYMENT AUTHORIZED," and some are not. An individual who has been granted asylum does not need an annotation on the I-94 or an employment authorization document to be issued an Social Security number and card for work purposes.

An employment authorization document (either Form I-688B showing "274A.12(a)(5)" on the face of the card under Provision of Law or Form I-766 showing "A5" on the face of the card under Category); or

An order of an Immigration Judge granting asylum under the INA. The document must be the original decision (not a copy) printed on paper stock bearing the letterhead "United States Department of Justice, Executive Office for Immigration Review, Immigration Court" and show the city where the immigration court is located.
NOTE: If you're a noncitizen, we must verify your documents with the Department of Homeland Security (DHS) before we issue a Social Security number or replacement card. Most of the time, we can quickly verify your documents online with DHS. If DHS can't verify your documents online, it may take several weeks or months to respond to Social Security's request. For more details, please see the answer to the Frequently Asked Question, How is SSA protecting Social Security numbers?

I agree with JW that unlike places where we come from, officials here even at senior levels are very responsive to average people like you and me. My story is that in Florida they have a very strict policy for non citizens getting driver licenses. Although the published rule is that people granted asylum should be treated like citizens and receive six year licenses, my uncle and my aunt were issed only two year licenses by the local DMV office. I protested to the office manager to no avail. He was just ignorant. So I send an email directly to Governor Jeb Bush' office. I actually never thought that would do any good.

But guess what. The director of the state's department of highway safety and motor vehicles personally replied to my email. He asked me to call his chief of staff on a direct line and the problem was solved immediately.

Guys. I remember someone posted a link to USCIS official document which clearly states that asylees are authorized to work in the U.S. Can u please share with us again. I would appreciate that.

To be brutally honest I was saying that you are pretty dumb in failing to obtain what national policy entitles you to obtain and everybody else in the universe can get. You need to look at the mirror and ascertain your basic ability to function.
