EAD Renewal Question ??

My wife's EAD expires on March 18th 2004. Can I renew her EAD before she leaves U.S, as she is leaving to India on 13th of Sep 2003 and returning back in Feb 2004?

This is what is recommended:

"It is advisable to apply for EAD extension more than 90 days before your current EAD card expires. If it is not extended within 90 days, you can also go to the nearest BCIS district office and obtain your extension right away. Procedure for filing the extension of EAD is same as new EAD, except that you should provide the copy of old EAD while renewing it. "

The way i read the above para is that you can apply! But check with your attorneys to find out if your wife's physcial presence is required within usa while her EAD extension is in process. I do think so but still consult an attorney!

Thanks for replying.

I did check with him yesterday and he mentioned to me that she needs to be in U.S, then only she can apply for renewal of EAD.

And also he informed me that, EAD renewal can only be applied 6 months from the expiration date. Is this true ?

Might be true, better call BCIS and talk to a Supervisor.
 
i think the same that the person applying for EAD needs to be physically in the country and one cannot apply prior to 180 days from EAD expiration.
