EAD renewal - missed the 90 day window

No - you cannot work under those circumstances. You would be working without authorization, though you would not be out of status. Unfortunately, the provisions of 245(k) only apply to employment-based AOS. You may want to consult an attorney to clarify what the potential implications of unauthorized employment would be.

It's been a while since you first posted your problem. Have you been able to find out what is the right thing to do in the case of EAD approval not coming in before the current one expires?

I am in similar situation as you are in and don't know what option to choose between continuing to work and taking a break.

I have some good news .. I was able to get an interim EAD eventhough I did not meet the 90 day criteria ( actually it was about 45 days ) . All I had to do was to get a letter from my employer stating that I won;t be able to continue working without a valid EAD and the lady at the seattle office was nice enough to give me an interim EAD the same day. I took an appointment "to speak to an immigration officer" not for the "interim EAD".

So you can try talking to your local USCIS office .. if they are in a good mood you may get an interim EAD..

As for continued employment, I was not able to find any info which confirms that you can continue working while EAD application is pending..
 
Hello all!
So could I get an interim if my card just expired in June 30th or it has to pass more time? Or, is there any way to speed up the approval of my new EAD?
I have read that one may fax a letter explaining the importance of expediting the process and they apparently would work on it faster. Is this true or not?
