EAD renewal limitation 120 day rule

Hi gurus,

I was planning on filing my renewal EAD 6 months prior to my current EAD expiring just to play safe that I would not be without an EAD in the interim. My attorney told me that USCIS has said that we cannot file more than 120 days in advance of prior EAD expiry. Also that there will no longer be an interim EAD if your renewal EAD is not approved after 90 days. Anyone heard of this ? Is this correct ?

--------------wrong info USCIS says file EAD 6 months advance.You can file for extension of your EAD up to six (6) months in advance of the current EAD expiration date. ask your attorney the copy of USCIS memo/law that you cannot file more than 120 days in advance of prior EAD expiry.

Also that there will no longer be an interim EAD if your renewal EAD is not approved after 90 days.
------------that is correct Local USCIS has stoped giving interim EAD the last day was 08/31/2006 at Local Offices per USCIS Local Practices and Procedures.


Anyone heard of this ? Is this correct ?
-----------file the EAD 6 months advance and you can file without lawyer

your attorney is completely wrong. On USCIS official website they encourage you to file for EAD extension in 6 months advance.
