EAD Renewal Gap options

Can someone help me with telling which options are legal/possible if my EAD approval doesn't come in time (its a renewal case, not new):

1) I keep getting paid and get a letter that I am on PTO (paid time off).
2) I keep working but not get paid (seriously - the project will suffer a lot if I have to sit idle)
3) I keep getting paid and temporarily go to India and work remotely - i am seriously considering this.
4) Don't work, don't get paid, sit on my ass.

Any other options?

I also would like to know as my renewal is coming up. Also want to know from you guys how many months in advance is it advisable to apply for EAD renewal?
 
GC finder, our EAD is up for renewal on Oct 23rd & our Attorney is going to re apply at the end of May.

How about:
5) Once it has been 90 days since you applied for the renewal, go for an Infopass appointment and insist that they expedite it. After 90 days you have that right.

Your options 3 and 4 are clearly legal (assuming you are an Indian citizen for #3). 1 and 2 puts you in legal gray areas where there are conflicting opinions ... some say it is OK to work with the EAD receipt, others say it is OK as long as you work without the EAD for less than 180 days, others disagree with those positions, etc.

1) What will happen to my EAD renewal?
2) If i send letter to USCIS and cancel my EAD renewal application, will USCIS refund my EAD renewal $$$ based on my approved GC?

120 Day Rule

You cannot file a renewal prior to 120 days of your current EAD expiration. File it as soon as you hit 120 days. I have always e-filed (I am on my 5th EAD now) and one of the benefits amongst others is that you get your RD at that instant.
If you dont get it in 75-80 days, take an infopass appointment on the 91st day - this way you still have a month before your current one expires.

5 years you have lived with USCIS and you still expect a refund from them? Forget it dude, enjoy the green!!
You do not need to send a letter to USCIS - they will stop process on your EAD and will burp up the $$$$ (they would have already done it by now ;) )

They won't refund anything. And the way they operate, the people processing the renewal probably don't know that your GC was approved. So they might approve the EAD anyway, even though it would be useless. I know of people who have had EAD, AP, and even H-1 renewals approved weeks after their GC approval.

They jsut approved my wifes case and there is an LUD on my case tooo.

Does this happen to any on that secondary approved but the primary is waiting.

Anyone? I don't have the luxury of 90 days IEAD since I filed late. I have to make a decision soon...if anyone has had a EAD gap, please post your experience or what steps did you take.

Where is your lawyer

I hope there is a very good reason you cannot ask these extremely important, critical questions to your lawyer.

That aside, you can work 180 days without any authorization before you jeopordize your adjustment of status. I think it is called 245 (i), not sure. My lawyer told me, when I was in similar situation, that when USCIS looks at this gao they won't object since they know that the client's attorney would come back with the 245(i) ruling.

But come on, don't be cheap, get a lawyer. These things are way too important. Cut down on those buffets if you have to.

My present EAD expires in July'18th, 2008.
I mailed my EAD renwal application to CHICAGO lock box.

My questions.

1) How long it takes to USCIS to cash my check?(In that way I can find my receipt number)


2) In worst case scenario, if I don't get approved by July'18th, 2008.
am I in trouble? Is there any way i can overcome it?

You should get your check cleared by Sat. Are you suppose to send to Chicago. Employment based should be sent to either Texas or NSC depend on which state you live currently.
The best you can do as soon as 60 days complete, you should call them and ask for the expediate processing.

I think it was a bit of everything...cheap, buffets, the fact that you were being such an obvious hypocrite. Just overall you came across as a low-life scum (evil or otherwise) who goes around stinking up whatever it touches. In the real world, douchebags like you probably get beaten up every now and then for your fake attitude, a la Sreesanth circa 2008.
