Hi Gurus. Could u please help me answering following 3 questions:

1. Do we need to renew EAD and AP if we do not use the current ones, being on H1?

2. If we do not renew the EAD, can we renew it later on when we need it (it will look like renewing expired EAD)?

3. Could we come back to H1 after using EAD?

thank you very much..

1. You don't have to apply for EAD/AP -- you can use H1 for working and traveling
2. You can renew it later -- it does NOT matter if your old EAD is expired.
3. Yes - you can. But why do you want to do that ?

Back to H1 after using EAD for few months

Kesab,

My current status is EAD (I-485 denied (due to employer not me)) but filed for MOTION TO REOPEN and working with the EAD. It seems it may not open soon, by that time I may complete my EAD time (I applied for renewal 90+ days before), not sure it can get approved or NOT.

I want to go back to H1. Is it possible or not? If yes, what is the procedure. I have a pending H1 (GC sponsered employer).

Thanks in advance for your help.

Thanks...the reason is that I am on H1 and may get another job (with the same employer). I do not know if they are going to apply for H1 again or not for change of employment.
If they don't I will use EAD.
If they apply, I will continue to use H1 (I hope I don't have to bear the $1500 again as H1 fees). In this case my EAD will expire in future without using

Some of my friends were telling me I may have problem renewing expired EAD later on (but they are just saying, not on the basis of experience ). But u r sure that I don't have to rennew and even will not have problem in renewing expired EAD.

thanks again

I'm sure that you won't have any trouble renewing your EAD because your old EAD has expired.
This I'm telling from experience.

If you are very concerned, you can keep renewing EAD for your peace of mind :D

BTW, my old EAD was expired for about 2 or 2.5 months before it was renewed just recently (of course I was not working on EAD !! :D)

That should be all the information you need to ignore what your friends are saying. The only requirement for issuance of an EAD is that the beneficiary be eligible based on a pending I-485, or valid L-2, E-2 or J-2 status.
