EAD Question

Hi,

My wife's EAD is expiring in a month's time and already applied for a renewal. I have a question. From my earlier GC process from another employer, my wife had applied for her EAD renewal and CRIS took 2 years to approve and got the card recently (which is valid till August 2009).

My question is, if the new EAD approval takes more than one month, can she use the EAD from our old pending case? ( Please note that in my earlier GC application, the I 140 is still pending and there is no change in status since Sept'2005.)

Please suggest.

To apply for EAD you have to have pending I485 related to any I140 application you like. I-140 without I485 has no meaning and by I140 itself you can not apply for EAD or AP. EAD and AP are privileges for those with pending I485 connected to I140 (for sure). Many people has many I140s but obviously have only one pending I485 which is the only application could be a base for any EAD/AP application. Sorry for the redundancy

Thanks for the quick response. In my both cases I have applied 485 and that's how I got my EAD. (Actually we have 2 sets of A #s)

The question here is, since my earlier application, no decession has been made, can my wife use EAD from my old case?

Yes she can if the I-485 (connected to the 2nd EAD) is still pending with no decision yet. What she needs is any unexpired EAD during any time she is working from any application you like.
