EAD Question

Hello,

My H1B expires in couple of months. I have valid EAD that is valid upto next April (2002). I heard somewhere that I have to fill I-9 form in order to use EAD. Is this true? Do I have to send this form to INS?

Please respond if you have any ideas.

To my knowledge you don\'t have to fill anything. My H1B visa is going to expire this month, and I have a valid EAD upto the end of this year and my lawyer has not asked me to do anything. Just having the EAD is good enough. INS has a record. Although, you would definetely need an Advance parole to travel.

You have to fill I-9 form with in three days of using EAD. That is, with in 3 days of your H1 expiry. You have to submit the completed I-9 form to your employer for their records. This should be kept with the employer at all times and does not have to be sent to INS. The employer has to pay a heavy fine if they don\'t keep the updated I-9 on their records.

Technically, I-9 is an employers responsibility. However, you have to tell the employer that you are no longer using an H1 visa to work and that you need to fill out an I-9 form which asks details about employment authorization. The EAD card has all the details. In a way you are protecting the employer by filling out I-9 form who submits a copy to INS. Even if you don\'t fill out I-9, you will not be in any trouble but I would recommend filling out an I-9 form and pass it on to the employer.
