EAD question, please help.

My current EAD is expiring on 11/27/02 and I renewed it in September. I was told it would take 60-90 days to process it. I am working on EAD only now. My question is: what happen if I will not get the new EAD after current one expired on 11/27/02. My company already asked me about this and I told them to check with our attoney about this. I am feeling I won't get my new EAD before 11/27/02. Anybody knows what will happen then?

Anybody can help? I appreciate it. I do have receipt number for renewal application from INS.

- You cannot work after 11/27/2002 until your new EAD arrives.
- If it's been 90 days since you applied (in September), you can go to the Dallas District Office to get an Interim EAD (valid for 9 months).
- Call TSC [214-381-2423] and ask them about the status of your EAD.

What is your ND for EAD?
 
EAD Renewal

Hi bajis.

What should I do now. My ND is Nov. 30 for EAD renewal and the receipt says it will take 80(approx) days to take decision. My current one will expire on Dec. 21.

Plz suggest me what should I do. Should I go to Local INS office to check about that.

I am in Oklahoma.

I hope Oklahoma Service Center is accepting application for EAD renewal(Interim)

I believe one can approach INS for an interim EAD only after 90 days from EAD's ND (or is it RD?!). Do you have a valid H1B? If so, it is easier to switch. Call your lawyer and ask for direction.

I am alreay working on EAD...don't think H1B transfter is possible.

Now tell me, if I will be without payroll for sometime after the EAD expires.. will that be a problem..

Can I join again after getting the EAD...
 
H1B extension will be an option?

MY current H1b will be expired soon and I applied EAD but not get approval yet. My lawyer told me that you can apply H1B extension and get receipt before your current H1b expried. Then I'm eligible to work while waiting 485/EAD/H1B.

So, talk to your lawyer for your cases.

I think FujiS is right. You can change from EAD to H1B. Just submit a new I9 form to your company's HR.

If you still have some life left in your H1B or if you have used up all the 6 years, it doesn't matter. Apply for your H1B extension and get a receipt. This will ensure continuous employment.

Yes if you stick with EAD and if it expires, you will be out of payroll till you get your new EAD. Once you get it, you can join back . Question is - can you trust your manager when it comes to joining again? :) (I can't!!)

I don't think a temporary out of work will affect your I485 approval. People join different companies (with a month lag in between) and still get approvals. You should be okay.

My H1B is with previous employer and I have used only 2 and half years...and right now its valid upto March'2003

Now I am with different company with EAD. So I think, I need to change my H1B first to the current employer, even if I want to change from EAD to H1B right...

Nope, you don't need a new H1B (in your current employer's name) if you have one already valid till March 2003 (even though it is in your former employer's name). Actually you could have joined the new company using your existing H1B.

Your case is hence very easy. Just approach your (new) company's HR and submit a new I9 showing H1B as the valid work authorization.

Sometime in January 2003, apply for your 3-year H1B extension (in your new employer's name). By that time, you might have got your EAD. But who cares about it ... !

With EAD, you'll have to renew it again in a year. With your extended H1B, you need not worry for another 3 years!

So there is no problem from switching from EAD to H1B..and no need to transfer H1B to change company.

But I knew that once you start working with EAD you can't go back to H1B again. Is the law changed recently or I don't know.

Please let me know and if "it is" really and then tell me what I can do for you...

Little bit puzzled.Please help me man what should I do...
