EAD Problem - NEED HELP PLEASE

Hi experts,

I am in a bad situation. Please give me your advice and help

I-485 is pending since Dec 2002. I am derivative, spouse is primary applicant
I applied for EAD-2 on Oct 16, 2003 VSC, got interim EAD at San Jose USCIS
Interim EAD validity: Jan 22, 2004 - Sep 17, 2004 (240 days)

The original I-765 (EAD) case never got approved. I put an inquiry in April 2004. This is the response I got yesterday (July 6) in the mail:

"Action on the I-765 was terminated on Feb 9 2004 since you acquired employment authorization through another office"

WHAT SHOULD I DO NOW?????

1) Should I e-file a new I-765 application ASAP?

2) Is there any appeal that I can make to VSC?

3) Even if I e-file I-765 ASAP, I will run out of work authorization before 90 days. Is there some way of maintaining work authorization continuity?

I think the beast way to deal with is call them and also send a letter explaing that you only got interim-EAD and not a regular EAD thru another office.

Don't waste time in trying to get justice or corrective action from VSC. Just apply for EAD. Then start putting pressure on them (through your congress man) to approve that before the expiry of the current EAD.
 
Just apply for renewal without delay

If you apply now, there is a good chance you will get the renewal before your interim EAD expires. My wife's renewal was applied Apr 21 and got approved June 28. So dont waste time, just apply again.
 
Thanks for all your responses. My attorney is suggesting to apply for EAD renewal and request an in-person expedite, which costs $1000. Do any of you know what this in-person expedite process is?
 
I am in a similar situation. My second ead is pending since oct 17 2003. After my interim ead expired, I went and got the 2nd interim ead. It was hard to convince the lady but she agreed to give another one. Now my iead expires on 11/11/04. I am still waiting for the approval of ead because they told me it can start from the approval date. If that is the case, I wont have to apply for a 3rd ead. Like your case they either wont approve it since I got my 1 year worth ead or they will give me another year for free :D
But this delay doesn't really make sense, it has been 9 months :eek: tooooo long....I got the first one in 20 days :confused:

I will wait till the first week of august, if nothing happens I will apply for a new ead..

From which office did u get the 2nd Interim?
What is the status of ur original EAD App? Still just received?

I got it from norfolk office. We applied for the whole family. Status are all same but LUDs are different. They started changing after I got the second iead. Mine is 6/30/04 and for others LUD changed today for the first time.

So, they gave u an intial iead for just 3 months?
Normally interim ead is given for 8 months, so for u that should have been thru Nov 11, which explains why she gave the 2nd iead in the first place and that too specifically thru 11/11.
