EAD potential problem!

december2002

I applied for I-485 and EAD in May and I have a receipt date of May 10. It has been 90 days and I still don't have the EAD.

How can I find out about LUD changes? Is there a phone no? The only phone no. I got is the customer service and it basically gives me the same information as in online. We received your case on may 10th and blah blah...What do I need to do?

Also, can somebody tell me what is the notice date and how is it different than the receipt date?

One more thing, I did not receive any fingerprinting request and my lawyer says not everybody receives that. Is that the case?

Any comments on these appreciated.

My PD Dec2002 ROW. I-485 filed in Nebraska.

Thanks...

Go to your local USCIS office and get an iEAD - I believe if you don't receive your EAD within 90 days of applying you can get the "emergency" iEAD immediately at the office... you may want to call USCIS and get confirmation on this. I remember reading it somewhere in a book or online.

Big issue

This is a big emerging potential problem which is escaping the radar due to everything else going on at the USCIS with the 485 fiasco, receipting etc.
The NSC has left its "currently processing" at March 26th in their July 15th bulletin. Imagine that they are effectively stating that they are behind the 90 day timeline. In addition they have updated their website asking you to apply a whopping 6 months before your EAD expires and they will still only give it to you for 1 yr.

Interim EAD is no longer a solution. The local offices STOPPED issuing those late last year citing security concerns. They are asking you to go to the local office and ask them to send a request to the regional service center for the interim EAD. How funny is that, they want you to ask the same people who delayed your original EAD application timeline for an interim one. A messed up solution if ever there was one.

I faced this situation and thought I was screwed and I would have to stop work until I was told that since I had not changed jobs yet, my H1b visa was still valid for work. Hence I was able to continue my employment.
My EAD (3rd one incidentally) with all medicals, FPs etc cleared by the way, was applied end of March. I finally got the e mail stating a card was ordered yesterday after about 4 1/2 months. With the coming Tsunami of application with the recent 485 fiasco and the accompanying derivative applications, this will seem reasonable in months to come.

The options as I found them are as follows.

1)Do nothing. Not as bad as you might think. We did nothing for my wifes case and my AP and those were approved quicker than the one for which I did infopass etc.
2) Call the service center. Pretty useless unless you luck out and get a helpful officer.
3) Take an infopass apt. My experience was not too good here either since, the officer though polite simply told me I would get a reply within 10 working days. Of course that did not happen. I did not make a follow up infopass. How many times can you keep doing this?
4) Call you congressmans office and speak with the assistant that deals with immigration issues and ask them to initiate a congressional inquiry. This is usually effective I hear. I got my e mail as I was planning this.

All in all a very unsatisfactory set of solutions. I hope they improve the service. Considering the new fees they are collecting, that is the least they can do.

My friend called USCIS (800 375 5283) and got EAD approved next day. He didn't call for his wife so she didn't get it. He had to call again for his wife to get it approved. You can try your luck too.

Thanks everybody.

Madboy, I called the USCIS last night and I got the card production ordered mail today. I was thinking about the exact same thing before I read your post. Is it a concidence that I called them and get the card order next day?

I guess we need to poke them once in a while so that they would start working:)

Actually my friend asked me what to do since he doesn't have an EAD. I suggested him to call CIS. He did that and the next day he told me that only for him it is approved. We were happy to hear that. But after one week he said it might be a coincidence which I can't believe. But it looks like you are confirming the theory of calling CIS after 80 days might do some good (instead of calling coincidence). Thanks for updating.
