I have a question regarding switching my status from H1B to EAD. Recently I have filed for EAD and I am anticipating it anytime next month. My H1B
will expire in Sep 2002, so my question is that coming on EAD (By filling form I9) will automatically switch my spouse status from H4 to EAD or any special paperwork has to be done for my spouse application. What if my spouse dosent get a job? Can any one of guru\'s explain this scenario.
Thanks
TG

EAD is NOT a status.

If your spouse wants to work she/he needs an EAD. Otherwise, AOS receipt grants her/him "adjustee" status, which means she/he can stay in the country for as long as AOS is pending. She/he may also maintain a valid non-immigration status (dual status) but this is not required.

how about the primary?

Does the primary need a non-immigration status (H1B or F1) when he/her is a "adjustee" for 485? Thanks.
