EAD or H1?

Hi All,

I recently travelled from India to US twice on the Adv. Parole. I have my H1 also renewed recently. I do not have my H1 stamped on my passport yet. I have my EAD till June 04. However, I am still on H1 on my company's payroll.

Do I need to renew my EAD or should I have to revalidate H1 on my passport?

----- if you are working on H1 with employer who filed your latest H1 then entring on AP does not invalidate H1 status, you can file H1 extension before your H1 expire or I-94 expire

------ You must renew EAD even if you are working on H1 status becase if any lay off you can join other employer if you have valid EAD in hand

----- VISa stamp is only needed for entry to US, FYI I read that DOS is going to stop Visa revalidations in US after August/september, better send your passport for Visa revalidation. If your H1 is going to expire then you also need to file H1 extension with USCIS before I-94 expires.

will file H1 extension 6 months advance of H1 expiry
Will also get H1Visa revalidated
will also renew EAD, will also file new AP

I have my H1 extension already done. I have my I-797 with me. I do not have H1 stamped on my passport. My prev. H1 visa expired on 1st Oct'03. So, can I now send my passport here in US for revalidation and also apply for EAD renewal at the same time?

----- send the passport for Visa Revalidation In US, one CAN send the passport for Visa Revalidation if Visa stamp has not expired more than 1 year
and ALSO apply EAD renewal, Visa is stamped by DOS and EAD extension is filed with USCIS service center where your I-485 is pending. one CAN have H1 and EAD, AP at the same time

My current EAD expiry date is 15th June. Is it OK to apply so late now?

How much is the current fee for EAD now?

I tried to visit E-EAD page but it is giving me 'You are not authorized to view this page' message.

------- If I am in your situation I will renew EAD and will also file H1 extension, H1 extension USCIS fees has to be paid by Employer. I will not think of saving H1 extension fees, because H1 status has its own advantages for you. If anything wrong goes with I-485 you will still have base of H1 to stay and work. Play safe, keep valid EAD if any lay off in future and also extend H1

------ if you get H1 stamp on PP you can go out of US any day and can enter US before H1 Visa stamp expires. AP takes 5-6 months for approval, if any emergency and you don’t have Valid AP in hand then H1Visa stamp is still worth, and with AP you need UK, Germany, France, Swiss transit visas, if you have H1B visa stamp in PP no need of Transit Visas, do what you feel better. I will keep valid EAD, valid AP and H1 stamp in PP and H1 extension filed

------- Apply ASAP, it takes 4-4 months
How much is the current fee for EAD now?
fees was $120 but on April 30 they have increased extra $55 so now it is 120+55=….

I tried to visit E-EAD page but it is giving me 'You are not authorized to view this page' message.
------ What is E-EAD page? If you have applied EAD and have receipt # then go to BCIS online status punch your EAD filing receipt # and you will know the status.
** don’t file EAD through efiling , Paper filing with Mail is better and no problems, with efiling many don’t have good experiences and it does not expedite the process faster, file with papers and don’t forget to attach the Color Copy of your Driving license+,Color copy of your first page of your passport that has your name, DOB, Photograph, I hope you know the other requirements.
* Don’t try to save on H1 extension this is not saving, play safe

I am sorry to confuse you. I meant H1 stamping. I have already got my H1 extended.

Is the fees for H1 stamping still the same?

Oh! I just found it out on Murthy.com. It says it will accept it till 30th Sep. So, does it mean I can send it say on 29th Sep also. Actually, I want to keep my passport with me till Aug 1st week for some unforseen reasons.

Secondly, I used my adv.parole while last return. So, will there be any problem in visa revalidation?

Do I have to send copy of my last I-94 or the one which I got with my I-797?

------ I will send my passport for revalidation ASAP. Murthy is not working with DOS, She only posts what update they get from various agencies. DOS may also change the date any time to stop revalidation or can make alternative arrangements. We don’t know the exact date when they will stop.

-----I don’t think any problem if you are on H1 status and maintain H1 status and has not used EAD. use of AP does not invalidate your H1 status if you are working with the employer who filed your latest H1

Hi all:

I am H1B approval notice as well as H1B Visa in Passport expiring by Oct 2004.
I am started the extension of H1. Once I got the approval notice, I am planning to send my PP for revalidating the Visa to St.Louis.

1)Is there any deadline (60+days before or after, etc.) for the revalidation?

2)Also, I renewed my Indian Pasport recently in US. So I have my earlier Visa stamped in the old PP? Is there will be a problem?
