EAD or H1? URGENT, please answer...

I am planning to travel international and will
have to get back to US using my AP.
(my H1 visa stamp expired, i do have a VALID
H1 work permit in US and am awaiting 485 approval.
I am currently working on H1 with my employer)

I thought I will have to file fresh I9 form
with myemployer and start using EAD _BEFORE_ I leave
US. But my lawyer says, I can get back to US with
AP and continue working with H1, is this true?

is the lawyer wrong?

I know this discussion happened a while ago. I did read
those postings. they seemed to indicate that I have to
be on EAD for me to be able to enter US using AP.

To avoid the confusion, why don\'t you try to get your H1 visa stamped before coming back? One of my friends was in a similar situation like you and he got his visa stamped in India.(It took him 3 days though)

can I avoid getting H1 stamped, if I start using my ead...
I already have a valid ead card....i could just use it
by filing new I9 form with my employer

Kumar, Go to ur employer and change your I9 to use the EAD. Come back with AP. There will be absolutely no problem this way. I have done this myself, and it is easy. Basically, go change your I9.
 
i will file I9

with my employer before I go
and come back on AP.
actually i dont see any disadvantage in working on
EAD as compared to working on H1.

(I am on 7th year extension of my H1 ,
my 6year limit expired oct 2001, so....I decided,
better get on EAD and
come back on AP...)
