EAD need help

my i-94 extension just got denied. i'm not on h visa.

my labor is approved.
lawyer preparing to file concurrent I-140/I-485/EAD
my employer also filed for my h visa last april

can i still get EAD even if i'm now out of status?

You are not eligible for EAD as your I-485 is not filed. Please note that you need a valid I-94 to file for I-485.

You will have to leave and do consular processing, or obtain a H1 visa and re-enter. Make sure you are not subject to any bars (3 or 10 years).
