Explain everything clearly.

REMEMBER: Maximum number of pages: 6 only and also try to fax from the fax machine which you will expect the fax reply from USCIS since they will fax you the status after they verify your fax and after reviewed by the officer.

Also mention your fax# in this cover letter.

Application Suppport Center is the other INS office which they work on taking applicants biometrics( fingerprints, thubprint , pictures etc..... As far as I know)

Hi Folks,

I have a latest update on my case. As I said before, Yesterday I went to local INS office with my Attorney as per INFOPASS schedule.

Finally after they verified the complete records in the system, they told me that Local USCIS office is not authorized to provide an interim card or new card since Service Center already mailed it to me after they approved my EAD renewal application in December 2nd week of 2005 which I did not receive in the mail for some reason. And also they told me that Local USCIS can not process my replacement EAD application which I have filed with Service Center in January 3rd week of 2006 since it has not been pending for more than 90 days since the filing.

Finally they suggested me to contact Vermont service center and work with the attorney to expedite the process(Which we already know as per my previous messages) for my replacement card application.

Since I don't have any other options to get my card and also I lost my work at client place(I can not work at client , because company said that I am on unpaid Leave of Absence and I can not work for their client also as for federal law) yesterday I have faxed the request to USCIS Vermont service center to expedite the process for my replacement card as early as possible. My Company provided a supporting letter saying that the project I am working is very critical for client and client can not go further without me and that will put the company in risk as well as client business.

I have to wait and see..............

As per my understanding, local INS offices will give the interim only if the case is pending more than 90 days with service center. Not for the cases like me which got approved and lost in mail.

If we are hearing that local INS offices are giving interim for the cases like me, they are lucky. Probably they did not like my face.

I will keep post if I have any updates on my case.

Any thoughts at this time ???????????????

Sorry to hear that you were not able to get any card from the local center. Is the expedite case processing for your replacement card or for the actual card? Would they have issued you an interim card if it was over 90 days since you had applied for a replacement card?

I am not even sure if this is possible but if you went to the Vermont Center would they be able to issue you a card? Anybody out there have any idea?

Applied for replacement card since we din't get the approved(old) one. So I don't think they can do anything for old one.

But at local office when I walked in first time thery took my biometrics at their support center with my old case(approved and lost card) only. I don't understand why they did that at that time since they can't do anything for the approval lost in mail cases(as per thieir conclusion yesterday). I guess the officer who did like that first time she doesn't know the things how it works...... Anyhow I don't have luck. If she would have told me the same thing when I went to local office first time(in Jan 3rd week 2006) what they told me yesterday(Local INS office can not do amnything), I would have work from that day itself for expedite process and I would have get my card before I lost my job.

Like you said, I have to call USCIS Vermont service center on Monday to ask them if they can give me a card in their vermont office if I can fly. Thanks for your idea.

I think the people at the Application Support Center are just trained to answer basic questions, check the form for completion and accuracy of data and take FP and biometrics. All they do is just take your FP and biometrics and link it to the case number and forward them to the service center. There would be no way for them to know if the case for which you were taking biometrics was pending or approved.

I think you should call Vermont Service Center and see if they would give you a replacement card or anything. Goodluck with that.

I have received a reply for my Expedite request fax from USCIS Vermont service center saying that, my request with supporting documents is not meeting the criteria for special handling and my application will be processed within the regular processing time.

No Luck here either for expedite process.

Hi Everyone,

Eventhough I failed in all my efforts which I have put for my interim/replacement card from local USCIS and vermont service center, Finally I got a success with my employer today for continuing my job with them and at client place aswell. I am back to work again starting from today after my 5 days unpaid personal leave of absence.

My project manager and her boss finally discussed with legal department in my company and asked them that why can't they continue my employment since I have all the proofs which is a testimony for all the facts which I am telling. With thier pressure finally legal department called to USCIS Vermont Service center and asked them whether company can take me back to work or not based on the situation by explaining everything.

It seems, service center said okay to consider my employment for a grace period of 90 days from the Notice date of my replacement I-765 Receipt Notice which I have filed with USCIS. Finally my company asked me to come back to work by showing my ORIGINAL receipt notice for my replacement application.

Today I provided that Original receipt to them and started my work. Now I have to pray for GOD to approve my replacement card application ASAP and get that card in mail without fail Or final approval of my I-485.

Best of Luck everyone who is struggling and waiting for result with hope.

My doubt is: will they give you a written permission or they just say it?
You use the word 'It seems .....', so looks like it's just the understanding
from your side.

The point is: will you get trouble in the future?
Because USCIS can simply deny what they told you today if there
is no written document. And each phone agent can have his own
understanding of the law, which may be wrong.

Your company wants you to continue to work becasue it's in the
best interest of them.

What does your lawyer say about this?

This is just my doubts, may be wrong.

USCIS did not give any paper work to my company saying that okay to continue my employment. The just said verbally when my company called to USCIS.

I heard different opinions from different lawyers. One lawyer said, I can not continue even one single day without EAD.

Other lawyer said that, if company wants to continue, they can go ahead by verifying with my replacement receipt and lost approval info from online.

Also one more lawyer told me that, there is a clause that they can take me back to work for a grace period like USCIS said.

I don't think I will have any problem infuture. But I could be wrong. But at this moment I don't want to think much about this since company doesn't have any problem with me.

You are right. Each immigration officer will have different opinion based on their knowledge. I guess nothing we can do about it.

Please let me know when you get your fax reply for your expedite request.
 
Too bad we have to go thru all of his kind of mishaps.

My lawyer asked me to apply for a renewal at least 6 months before it expires. It's not paranoid. It is for the sake of safty.

I had renewed EAD card lost in mail also; and replacement application got rejected since my lawyer forgot to sign a check.

So I am working w/o a card. However, my layer said I am still an H1b, tho I have i-9 filled and used AP.

I think having an approval notice of the lost card should also count. I got the impression from some posters and conversation with an USCIS rep.

Sorry for my later response, these days are all messed up.

Last Friday, I got the response from USCIS saying expedite
request does not meet their criteria. So it doesn't work.

On Wednesday, I went to the local office, but no luck there
eithor. They will not issue interim card for an approved case.

So I don't know what to do now, except waiting for 2nd case
to be approved.
 
Hi, niwseeker2004, i m fully understand how u feel now.

I have been toutured by EAD in the past 2 years. Actully, most of the fault were made by post office.

Last year, my approved card lost in mail. I can not get a interim card as same as u. have to refile. This year, I efile, and sent out my supporting document the next day, and then, after 60 days, INS send me mail for RFE, Because they never get my supporting documents. The mail i sent out 2 months ago, got lost again.!!!! I have to resent everything again. The problem is online statement changed after they got my RFE, i HAVE TO WAIT ANOTHER 30 TO 90 DAYS TO GET IT APPROVE!!!!! and my current situation can not get interim card either, only 90 days after they get RFE, THEY WILL ISSUE INTERRIM CARD.

i can do nothing about this situation. Only pray to God. I live in my current address almost 5 years, My mail barely lost, but the few lost mail always be the fatal one, that kills me and my family.

Sometime, just do our best, and God is watching everything.

Hi All,

I have an update on my replacement card. As per USCIS online case status info yesterday, USCIS approved my replacement EAD (I-765) application and also they ordered my new card. Hope I will get my card in mail without failure this time.

Thanks a lot for the GOD and USCIS... for my replacement approval with in 35 days from the Receipt Notice Date.

I wish you all GOOD LUCK in your cases approvals also.
