EAD is pending - Changing Employer

I have applied for EAD renewal more than 4 weeks (10/02) and still waiting. My current EAD is valid till Dec 2005.

I am planning to change employer with AC21 option and joining date would be around Dec 2005.

If my EAD renewal case remains in “PENDING” status even till Dec then Can I still apply iEAD at local office using this file reference OR do I have to file EAD thru new employer?

Please advise.

you may be qualified for iEAD if there were no rfe inbetween. remember rfe will stop & resume the time.

with current window its better for you to wait till the renewal. not a must. but safe approach.

ead is not tied to employer. its tied to your i-485. either you or your employer can file for your ead.
 
Hi,

If the person is working on H1 and having EAD (but not used yet), can the person switch the employer after 180 days using AC21

As long as you have work permit, you can change employer with AC21.
You need to transfer your H1 or simply switch to EAD.
