We both got EAD cards and my wife went to India with AP, due to death in the family. But as we are in family way, she is also thinking to have baby in India. In such cases, what legal to procedures have to be done on behalf of the baby.

An advise is greatly appreciated.

Assuming the baby is born in India, if you are not maintaining your H1 status, you will have no status on which to get your baby to the US. I mean, on what derivative status will the US Consulate issue a Visa to your Child. AP & EAD only allow you to get back to the US and will not get a visa for your dependents. In this case your child will not be allowed to join you and you will have to sponsor the child on the family based categories after you get your GC which could take several years. In my opinion, for your family to be together in the US, it is prudent to have the baby in the US. Again, as always, consult your attorney and don\'t treat this as legal advice.

My friend was in a similar situation. Their lawyer advised them to have the baby in US. I think you cannot bring the baby to US for 2 yrs, if the baby is born outside US. Please consult ur lawyer.
