EAD-- how to start using it.

My h1b expires this Sep... My 140 got approved few months back... and have applied for a EAD - II a month back..

I was debating --whether to extend H1b or go on EAD .... ?

--- decided to do EAD and let H1b expire.

Que 01 : How do I start using EAD?

Que 02 : Did I take a risky decision by letting H1b expire.

Ans 01: File a new I-9 form with the employer.

Ans 02: In my opinion, it's not risky, but it will be better to extend your H-1 just in case your I-485 is denied. Also, I think your employer has to pay for all the fees related to H-1; at least my employer did. For ead and ap, my employer did not since they are not necessary to keep me employed with the company. So, it's cheaper to have H-1 extended.

Do I have to fill I-9 and keep in my personal file in the office... Do I have to inform the USCIS about it.


Hmm H1b xtension my employer will not pay... for EAD they said yes as its lot cheaper...

EAD related Query!

I have a query about EADs!
I have I-140 Eb1-OR approved and pending I-485 case.
While I continue to use H1b VISA for my work..... My wife is on F1 VISA and doing MBA. We both applied for EAD based on pending I-485 and got it but we never used it. Now my wife will be finishing her MBA and would like to use her OPT for future job.

1. While we continue to possess EAD. ....Will that affect her getting work permit based on her OPT?

2. She doesnot want to use EAD as she beleive once she lost her job she needs to get back to H4.

3. While on OPT based permit she can continue in F1 status as long as OPT is valid.

any comments/suggetsions are welcome!

I think your employer has to send it to DHS.

My wife was on F1 when she applied for AOS in Aug'04. She got her EAD in Nov04. In Dec, as she was about to graduate, her ISO told her that her OPT EAD will get rejected as she had a EAD based on 485(immigrant visa) and now she is applying for a non-immigrant EAD. She tried anyway, mentioning on her EAD application that she has a 485 pending and she attached her 485 receipt. She got her OPT EAD approved in Jan'05!
My attorney advised that when we come back from our India trip to change to 485 EAD and not be on OPT anymore. She did that when we came back from vacation to India. Hope this helps.
