1. If I use AP to enter US, am I considered to have abandoned my H1b and forced to work on EAD? My lawyer says no, but I read different opinon from this forum sometime ago. If my lawyer is correct, I wander WHY there are folks who take the trouble to apply H1b visa even when they have AP in their pocket already?
2. If I am on EAD, and somehow my 140 or 485 got denied, a friend told me that I will have to leave US AND stay outside US for 1 year before I am elegible to apply H1b, regardless if I have used all my 6 years H1b or not. Anyone heard about this before?
