Ead/h1b/1485???

RD - AUG 20, 01
ND - OCT 13, 01
FP - MAR 26, 02
AD-???

-still working for the same employer who filed for H1b + labour + i140+ i485

-never left the country
-H1b is not stamped on the passport.


I have recently applied for EAD (check cashed by INS July 31, 02). Now my H1b is expiring on OCT 1, 02. I am just wondering if either my EAD or I-485 does not get approved by OCT 1. I will still be legally authorized to live in US but not work. I asked my lawyer and they said if we apply for H1b renewal by Sept 15, 2002 than even if neither EAD nor I 485 gets approved, I would still be allowed to work as there would an H1b renewal application pending.

What should I do??

Is it true that i am legally allowed to work if my H1b renewal is pending?

Having I-485 + EAD + H1b Renewal application all at one time going to screw up anything??

Yes. You can legally work when your H1 application is pending. People usually start the next day after mailing their application.
 
YES.........

You can apply for your H1 extension and immediately start working. And applying for H1 extension doesn't screw up anything.
 
as if the earlier answers are not to the point, let me also say that this is absolutely allowed. I know coz I did it myself.
