EAD For my Wife

Hi,

I am on H1 and I concurrently filed my I-140 and I-485 under EB1 in December. As the same time, I filed an I-485 for my wife (as a dependent) as well. We received the Receipt Notices for both our I-485s.

My wife is currently on F1, and we wish to apply for her EAD card. Will that effect my H1 status? In other words, can I still continue on H1 even as my wife obtains her EAD through her pending 485?

Yes, your H1 will be fine. It's your wife's F-1 status that she should be a little more concerned about, or rather be careful with.
