EAD for kids/minors.

HI ,

Currently I am working on H1-B. My wife and our kids are on H4. My wife and I have EAD also, but have not used it so for. Our kids do not have EAD ( I guess kids do not get EAD).

My question is if I started working on EAD, by showing the EAD card at work, I will still be leagal here, but how about my wife ? How about my kids who does not have an H4 equivalent of EAD ?

Can some one tell me the procedure to switch to EAD and the leagal status of kids during the EAD use.

They will be in Adjustment of Status (AOS)

After filling I-485 you family will be in legal status till the result of I-485.

Not that it matters. Unless you want to start a college plan for them.

Kids can have EAD.

Mine got it in order to get a SSN which is mandatory for a college savings plan.

Can some one tell me the procedure to switch to EAD

You just tell your HR that you want to switch to EAD.

You will fill a New I9 form with your HR with EAD as your status.

BTW I9 is employers responsibility so your HR will help you.
