EAD for driver licience renewal, does it invalidate the H1 status ?

Hello Gurus,

I just received my EAD card recently. My H1 will expire March 06. I have filed for 7th year extension.

If I use my EAD for Driver licience renewal What is my status. I am on EAD
status or H1 status.

By using EAD for Driver licience renewal will it invalidate the H1 status ?

Using EAD to renew your DL will not invalidate your H1, you are just using the EAD as a proof of your legal stay in the US.

You don't need EAD to prove your legal status.
A pending 485 automatically grants you the legal right to stay in the US till its adjudicated.

EAD is only used for prove employment eligibility.

In any case, back to the OP's question -> you will lose H1 status only if you use your EAD to obtain employment (i.e., fill out an I-9 based on the EAD) - you are cool otherwise.

Try telling that to morons at NJ DMV. Only documents they will accept are GC or I94. I heard they won't entertain even a valid AP. The state govt. has no qualms about collecting taxes while you are working with H1 extension pending, but they will not allow you to drive to work until you show them H1 approval with a valid I-94

Even this statement is a grey area. Some lawyers say you loose H1 status only if you use your EAD to work for some other employer.
