EAD for a Second Asylum Applicant?

Hello guys
I have filed a second asylum application because the first one was denied while I was in valid immigration status. Now, I'm out of status and the new application has been pending for 150 days. I want to apply for the EAD. The problem is that USCIS has never sent me a receipt. However, when I sent an inquiry they replied saying "no interview has been scheduled yet." I have not done biometrics for my second asylum application. Is it likely that I encounter problems when I file for EAD? Also, is the letter USCIS sent me stating that I have have a pending case enough as proof of pending case? Anybody has been through something like this before? Thank you in advance!

How come USCIS never sent you a receipt number? I find this more wired and if I were you, I would begin from this point. Does it mean they are using your old receipt number? You said you sent a status inquiry for your asylum case, in their response did they write your A-number? Was is the old one or the new one? I would call USCIS and get a clear clarification before going ahead with the EAD application. If its the old one, then I would go ahead and send the EAD application with the old receipt copy, assuming you still have it. You should also include the letter, just in-case.

When I sent a new application, my lawyer also filed a motion to reopen my old case. Whenever we send an inquiry to USCIS they always reply saying no interview has been scheduled and they will notify me when they do. The A number is still the same. In any case the A number will not change because like a social security number it is what USCIS uses to identify you. My lawyer wants to charge me a really big fee to file the ead on my half. I'm going to do it myself. He has previously contacted somebody he knows at USCIS and they told him that they have a huge backlog and that's why they haven't taken any decision on my case yet. I do not want to pay a ridiculous to him just to file a simple document.
