Gurus I need some some help.

My H1 is expiring in Jan 2003 and my present EAD is valid up to FEb2003 although we have not used EAD or AP. I am still with my original employer and (touch wood) see my job safe till next June.

My company will pay only for either H1 extension or EAD extension. I want to maintain my H1 status till I get green card. So I have asked them to go ahead and extend my H1.

In the worst case if I still do not have my Green card approval by Dec I would like to extend EAD. My WAC-02-041-***.

Questions:
1. How many days before expring current EAD I should file for
EAD extension?
2. Which form I need to fill up and roughly how much it costs for extension?
3. Does it take same 90+ days for EAD extension also or I can go to local office and get something qucker.
4. What if MY current EAD expired and I haven't rec'd new EAD ( in case I start using my OLD EAD) which is less likely.


I know still there are 5 months before EAD expires and my AOS can be approved anytime but Just want to be ready for the worst.
 
INS (CSC) is taking about 6 months to approve EAD renewals so now may be the right time to file for the EAD renewal if you need EAD. You have to use form i-765 .
I filed it myself for renewal and the fee is $120. Form can be downloaded from
http://www.ins.usdoj.gov/graphics/formsfee/forms/

I am told that 90 day rule applies to renewal as well that is you can after 90 days go to an INS office and get an interim EAD.

Try to read all the information on the INS website; there is a specific order in which the documents need to be put in, a way to write the cover letter (try to use the H1/EAD template from your lawyer) and things about where to punch holes and where to use tags (or not). And then just send to the correct address (along with the p.o.box number).

Thanks a lot for the info. I will wait till October end and if my AOS is still pending then I will file EAD extension as I will still have 90 days before my EAD expires.
