EAD Extension

Hello,

PD(EB2/INDIA): March 03 2004,
I-140(AD: May 27 2008) ,
I-485(RD: AUG 08 2007).

I have my/spouse EAD coming to expire Nov 2008. Since my PD is Current and processing date for I-485 (July 14 2007, as per today), I am expecting my I-485 to be processed (But not sure, how long it takes).

My question is:
1.Is it compulsory that, I need to extend my EAD, since I have already have it from last year.
2. any consiquences, not extending EAD.
3. Can I extend only for my Wife and not for me.
4. I am on my 9th year (H1-b) and its expiry time is: march 23 2009.

------------------if YOU are working on EAD then file for EAD extension if on H1 not needed as you expect I-485 approval. Same for your wife if she is using EAD then she need valid EAD for work

---------------- No problem if you or your spouse are not working on EAD

*** if you or your wife file for EAD or AP and I-485 gets approved BEFORE EAD Extension or AP then EAD or AP will be denied as USCIS cant process EAD or AP if I-485 gets approved

1. Yes, if you're working using your EAD. No, if you're working using H1. Your last year's EAD is valid only till the printed date. That's why it's called expiry date.
2. You won't be able to work on an expired EAD. If you do, it's a serious offence. However, if you're working on H1, then yes, you can let your EAD lapse and not get a new one.
3. Sure, if she's the only one working.
